Terms and Conditions
Welcome to ZigZagZay Mobile Art Venues LLC! These Terms and Conditions (“Terms”) govern your use of our services. By booking and participating in our events, you agree to be bound by these Terms. Please read them carefully.
1. Booking and Payment
1.1 All bookings must be made through our website or by contacting our customer service team. The reservation date must be reviewed and approved by our customer service team.
1.2 A 50% non-refundable deposit of the listed package price (not including sales and discounts) is required to secure your booking date and time. The remaining balance must be paid by the Monday before the event or as listed on the reservation confirmation form.
1.3 Payments can be made via Zelle, Paypal, or Chase Mobile, .
2. Cancellations and Rescheduling
2.1 Due to the reservation nature of our business we do not offer refunds on your 50% deposit. Cancellations will have the opportunity to reschedule the event/party for another available date.
2.2 Events must be rescheduled within 90 days of the request to reschedule, and the new event date must be within 6 months of the original reservation date. Deposit will not be
2.3 Rescheduling is subject to availability and must be requested at least [3] days before the event.
2.4 We can only allow one rescheduling. A second request to reschedule will be denied and your 50% deposit will not be refunded.
2.5 We reserve the right to cancel and/or reschedule any events due to non-payment at any time after the balance due date. We will contact you via email with your rescheduling options.
2.6 In the event of severe and/or inclement weather; including but not limited to heavy rains, thunderstorms, flooding, tornadoes, hurricanes, tropical storms, hail, sleet, snow, and ice on the roads, events will be rescheduled. Decisions to travel are based on our route and at our discretion. We will inform you of any weather interference as soon as possible.
2.7 In the event of mechanical issues or other unforeseen circumstances on behave of ZigZagZay Mobile Art Venues LLC, we reserve the right to reschedule or cancel the event. In such cases, a full refund or rescheduled date will be offered.
2.8 Refunds will not be issued for participants who do not show up. We encourage you to notify us of a proper head count at least three days before your event.
2.9 A refund will not be issued for any parties already hosted, under no circumstance.
3. Parking Requirements
3.1 It is your responsibility to secure appropriate parking space for the bus. Bus is approximately 40 feet long. Preferred space includes your private property or neighborhood street. You must secure appropriate clearance from HOA, management, clubhouse, apartments, hotel, private businesses, parks, and other public spaces.
3.2 ZigZagZay Mobile Art Venues LLC will not provide documentation or waive any rights of possible claims that may arise on public property.
3.3 ZigZagZay Mobile Art Venues LLC is not liable if you fail to obtain proper clearance and approval. If we are asked to relocate we may need to cancel or reschedule your event and in this case, you will be charged an inconvenience fee. If we can park within 3 miles of the original location the party time may be altered and/or may result in a reduction of party time.
3.4 We will not park anywhere that may result in danger to a person, equipment, or property.
3.5 Refunds will not be issued for failure to adhere to our parking policy.
4. Participant Requirements
4.1 All participants must be between the ages of [5] and [16]. If any participant is determined not to be of 5 years of age or older your party will end.
4.2 A parent or legal guardian must complete and sign a consent form for each participant.
4.3 Participants should wear appropriate clothing for painting activities. We are not responsible for any damage to clothing or personal items.
5. Safety and Behavior
5.1 Safety is our top priority. All participants must follow the instructions of our staff at all times.
5.2 We reserve the right to remove any participant who is disruptive or poses a safety risk, without refund.
5.3 A parent or guardian must be preson for all parties requiring only one paint attendant.
5.4 No illegal substances are permitted on the bus at any time. No alcohol is permitted on the bus for parties with any participants who are under the age of 21.
6. Liability
6.1 ZigZag&Zay Mobile Art Venues LLC is not responsible for any injuries or accidents that occur during the event, except in cases of gross negligence or willful misconduct by our staff.
6.2 Parents and guardians are responsible for the behavior and actions of their children during the event.
7. Privacy and Data Protection
7.1 We are committed to protecting your privacy. Personal information collected during the booking process will be used solely for the purpose of providing our services.
7.2 We will not share your personal information with third parties without your consent, except as required by law.
8. Media Release
8.1 We may take photographs or videos during the event for promotional purposes. By participating, you consent to the use of these images on our website, social media, and other marketing materials.
8.2 If you do not wish for your child’s image to be used, please notify us in writing before the event.
9. Miscellaneous
9.1 No outside food, drinks, snacks, candy, or cake is allowed. We provide all pizza, drinks, and cupcakes included in packages.
9.2 We will have pizza delivered at the time of the party. If you are in an area where pizza delivery is not available, it is your responsibility to notify us 24 hours before the event so that we may make accommodations.
9.3 We do not offer any combined package or theme combinations or food substitutions for party packages.
9.4 Please have all little artists use the bathroom before entering the bus to ensure maximum creative time.
9.5 As booking host it is your responsibility to notify parents of all attending artists of the party details. You may refer parents to our website.
9.6 As booking host you are responsible for notifying ZigZagZay Mobile Art Venues LLC of any allergies and requests for special accommodations.
10. Changes to Terms
10.1 We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website, and it is your responsibility to review them regularly.
